ICE to Release Illegal Immigrant Names

August 8th, 2010

From the Manassas News & Messenger:

Prince William County, Va. – Immigration and Customs Enforcement officials will release to Prince William authorites the identities and final disposition of every convicted criminal illegal immigrant apprehended in the county and turned over to ICE, said Chairman Corey A. Stewart on Saturday.

Stewart indicated that this reversed three years of “stiff-armed” responses by ICE to the same question. “They’ve also said they will increase detention center space in Virginia to hold illegal aliens until deportation. It won’t solve the problem, but it will help alleviate the problem.”

Stewart says “this data is the tip of the iceberg” and will show that millions of convicted criminal illegal aliens in this country have been released while awaiting deportation.

“This is not a small number we are discussing. Americans will be shocked when they realize how many convicted criminal illegal aliens are being released back into our communities and how long their deportation proceedings take.”

The county’s most recent request was a letter from Stewart to ICE Assistant Secretary John Morton on Aug. 5, on the heels of the early morning traffic death of Sister Denise Mosier on Aug. 1.

An illegal immigrant with multiple convictions is charged in the accident.  Prince William County’s top prosecutor said he will ask a grand jury to upgrade charges against convicted drunken driver Carlos Martinelly Montano to felony murder.

Montano, an illegal immigrant from Bolivia, was arraigned Wednesday morning on charges of involuntary manslaughter,  drunken driving as a third offense and driving on a revoked license in the Bristow Road crash that killed Mosier and seriously injured two of her fellow sisters.

A judge ordered him held without bond at the Prince William-Manassas regional jail.

—Staff report

Surprise!  Supervisors were warned 3 years ago to spend their money where they had control.  They were warned 3 years ago that there was a limit as to the number of illegal immigrants who could be picked up by ICE per month.  However, they plowed ahead with their plans, ignoring the warnings they were given about limitations of 287(g).

Apparently Mr. Stewart and some of the public didn’t listen during the many supervisors’ meetings held to explain new policy to the good people of Prince William County.  We were told that ICE could only pick up a certain number of people and that they would not be here daily for their ‘catch.’  We also were told that ICE does not deport anyone and that only a federal judge can sign off on a deportation, following a deportation hearing. (that rascally due process!) There is also a limit to the number of federal deportation judges and they do have to sleep sometime.

Jail Superintendent Pete Meletis told us early on how many illegal immigrants were showing back up in the community.  Mr. Nohe must have been listening because he commented on the large number.  Was he the only person listening?

Just out of curiosity, where will we or ICE put criminal illegal immigrants while they await deportation hearings?  What Stewart does not explain is where these 3000 immigrants he talked about on Fox News would be housed.  He also doesn’t explain how to speed up the road to  detention hearings.  The backlog is tremendous.  In short, he trumpets that he is getting names from ICE.  And then what?

I feel like there is a big rat wheel out there and we are on it.  Why is the outcome expected to change?  7000 ICE agents.  50 states.  Do the math.  Unlike Stewart, I don’t buy into the Corey theory  that Napolitano and Obama are responsible for this big mess.  It was a long time in the making because our immigration policy needs extreme overhaul.  If Corey Stewart continues to make enough noise (and that’s what it is),  perhaps even Congress will remove its blinders and see the need for immigration reform in the form of  Comprehensive Immigration Reform.

Corey knew and understood the issues with ICE as the following excerpt illustrates.

Washington Examiner  (October 14, 2009) [Bold provided by Moon-howlings]

Under a new agreement with ICE, the county will target illegal immigrants who commit serious, “Type 1″ crimes, such as murder and armed robbery.

“We are confident that we will be able to continue to operate as we have in the past under this [agreement],” county Police Chief Charlie Deane said. “Overall, I don’t think these changes will significantly [change] how we operate. In reality, 287(g) is a small part of the police department” program.

However, there will be some slight changes in the detention portion of the 287(g) enforcement program, which allows local law enforcement officials to enforce some federal immigration laws, Meletis said.

For example, if a suspect enters the jail on a robbery charge and is found to be in the country illegally, a federal detainer would be placed on him. But if that person was charged with a less serious crime and has not encountered ICE previously, he most likely would be released to appear in federal court, Meletis said.

“[ICE is] pretty well focused on those [serious criminals], but will take the [Type] twos if they have the resources,” he said. Type 2 crimes include driving under the influence, fraud and weapons offenses.

Board of Supervisors Chairman Corey Stewart, R-at large, said the new federal directive was “disappointing,” arguing that illegal immigrants who commit minor crimes can move on to more serious ones.

“[It's] common sense — if you’re an illegal alien and you commit a crime, you should be deported,” he said.

The new agreement took into account a March  report from the Government Accountability Office, Congress’ investigative arm, which criticized the 287(g) program for lacking “key internal controls.” It also requires participating jurisdictions to meet annually with ICE to provide updates.

Just out of curiosity, where does all this tough-guy posturing and posing at ICE  leave Manassas and Manassas Park? They use the same jail facilities. Were they thrown under the bus like most who have dealings with Corey?

Corey knew the score.  He did nothing.  Possibly  he was persuing other interests.  Then when AZ got into the limelight, he returned to his old watering hole, illegal immigration.  Perhaps he should be pointing a finger at himself rather than at President Obama and at Secretary of Homeland Security Janet Napolitano. Corey has been in office longer than they have.

You missed the big story here. It seems pretty obvious to me that ICE and President Obama are buckling on this issue.

As to what we do with the names, we can start by ensuring that none of the illegal immigrants use any County services.

I LOVE reading your rants against Stewart. You dislike him so much that you just sort of ramble around aimlessly when criticizing him. You’d be better off just saying “I hate him….he’s a poopee-head!”

As more states and counties enter the 287(g) program, PWC will have even fewer detainees picked up by ICE – merely because the resources will be spread thinner. Corey should have concentrated on our local problem. By trying to make a name for himself nationally or statewide, he’s going to hurt PWC. But then again, what does he care…

  4. August 8th, 2010 at 11:23 | #4

    @ Rick Bentley

I guess that will show them!! How are you planning on enforcing that? Which county services? Are they using them now? It sounds to me like you will still have illegal immigrants not in captivity.

President Obama might not even know. I think that localities should be notified of the disposition of each case anyway, just as a courtesy. All law enforcement should be doing that just as a courtesy.

  5. August 8th, 2010 at 11:26 | #5

Censored, he doesn’t care, I feel certain. You are completely correct. Resources will be spread thinner and thinner. Corey is blustering again. The good thing is, he gaffes will become more public. I am still snickering over the blame Obama gaffe yesterday…it’s all Obama’s fault and has been for the past three years!!! (paraphrasing the Faux News interview)

    More arrogance: From WTOP:

The Benedictine Sisters of Virginia tried to discourage using the death of Sister Denise Mosier as a “forum of the illegal immigration agenda” and pleaded for a focus on “Christ’s command to forgive.”

“The sisters’ mission is peace and love,” said Corey Stewart, chairman of Prince William County’s Board of Supervisors. “My mission is law enforcement and the protection of public safety.”

I thought Chief Deane was the top law enforcement officer. Isn’t the Board of Supervisors the executive branch of local government? Don’t they make the laws? Corey gets confused again. He also tries to trump Christ’s command. Watch out for that big bolt shooting down from the sky.

  7. August 8th, 2010 at 12:21 | #7

Cory just gets more entertaining and contemptuous. More from WTOP:

Stewart rushed back into the immigration debate after the Aug. 1 accident, firing off a statement that President Barack Obama, Homeland Security Secretary Janet Napolitano and members of Congress “all have blood on their hands.”

This is a time for introspection, Corey. He knew that those not being deported were being released back into the community. He knew that those who were awaiting deportation hearings were not incarcerated. HE KNEW THIS. How dare he say Napolitanom, Obama and Congress have blood on their hands when he KNEW this was happening. What a hypocrit!

    Hypocrite?? Not as defined by Webster;
1 : a person who puts on a false appearance of virtue or religion – does not apply
2 : a person who acts in contradiction to his or her stated beliefs or feelings
    - does not apply

I guess it might apply to anyone who argued against illegal immigration but then did everything possible to subvert immigration law enforcement.

Corey has every bit as much blood on his hands as any of the people he is blaming. All we get from him is bluster on immigration while he gives his developer campaign contributors everything they want. Developers are among the most notorius employers and exploiters of illegal labor. Arizona’s SB 1070 deal directly and effectively with illegal employers, but Corey won’t even mention those provisions, much less make a serious effort to get them enacted here. The judge did not impose an injuction against any of those provisions in the Arizona law and they are prefectly legal.

If we dealt with illegal employers there would be virtually no illegal aliens here. They come for work, not to be crammed into overcrowded homes and to hear Corey Stewart denigrate them as sub-human.

Don’t expect Corey to propose anything effective and legal on illegal immigration, or anything that would offend his developer friends, or any other employers of illegal aliens, who are lining his campaign coffers.

Stewart better wipe the blood off of his own hands before he accuses anyone else.

    @PWC Taxpayer

That definition seems a perfect fit for Stewart to me. Cast yourself as the champion of the illegal alien cause, and then enable the biggest employers of illegal aliens with no hindrance to or consequences from their actions? How does Webster’s definition of a hypocrite not perfectly describe Corey Stewart?

  11. August 9th, 2010 at 09:41 | #11

    I agree Need to Know.

@TP, He also knew that ICE was releasing illegal immigrants back in to the community. I can post the video if necessary. So if he knew, why did he let up on it? It has been going on since 287(g) went in to effect. So if he knew, and he did nothing, why is he now pointing a finger at others?

You are attempting to set your own boundaries on my statement and I am not going to let you get away with it. I say he is a hypocrite, which you obviously missed, because he knew about something and did nothing, then said others had blook on their hands. In fact, he dropped the immigration issue. (see Washington Examiner).

I would question also how much Corey really cares about illegal immigration past it being an election tool. Just going by what he says in the community……

So what are we saying here — that every politiican that takes on any issue and does not develop a comprehensive response to that problem – one that addresses all aspects of the issue – or even if he does and is blocked by some special status quo interest group, is hypocritical for having tried? Thats crazy.

So lets say a politician does take on some limited aspect of a problem and tries to deal with part of it and starts a political fight — is he hypocritical because of the attention he goets for trying or because those that oppose him seek a different answer – a more comphrehesive response to be sure the parts they are concerned with (amnesty) is in the plan?

  13. August 9th, 2010 at 16:28 | #13

We are saying that Corey made an inflammatory, comment about the President and Napolitano having blood on their hands and if that is the standard, then so does he. What’s so difficult to understand about that. He needs to stop making inflammatory statements. He knew the score right here in the county. What did he do about it?

Need some proof he knew the score or will you just keep weasel wording?

  14. August 10th, 2010 at 05:39 | #14

    @Slowpoke Rodriguez

No, Slowie, I am better off detailing why I and others feel Stewart is a horrible candidate. We have all the proof. I am not impressed with the people who continue to allow someone who will disregard all moral and ethical consideration just to get elected.

Is this the best you all can do? Fall in behind Supervisor Stirrup if you must. He at least believes in his cause and isn’t using immigration as a political ploy.

You had better stick around then if you love my rants because I plan on continuing with them. The good thing about Corey is, he continues to put his foot in his mouth. He is short of like shooting fish in a barrel.

    @Moon-howler

Moon, you really need to deal with your hate for Corey. It is neither rational or healthy. What did he do to you personally? Even in the political context it is over the top.

Corey is hardly responsible for illegal immigration or the fact that this Administration is back to releasing detainees back into the population. Knowing about it, complaining about it and being able to do anything about it are very different things. The folks in charge – as a matter or policy let the killer into our population.

  16. August 10th, 2010 at 08:06 | #16

No, TP, you really don’t get it do you? He is an extremely poor candidate for office and he throws his constituents and colleagues under the bus to advance himself. You really haven’t shown up here as one of the more knowledgeable people on the issues that Corey has really pissed people off over.

And regardless of the issue, the fact that he cannot be trusted and the fact that the most important issue to him is self-promotion is reason enough for most people.

Elena and I have a duty to share the information we have with others. If you chose not to listen, then leave. It really is that simple.

Perhaps you might want to take your own advice and do a little self reflection about the current administration. Hate much?

Rest assured that I will continue to expose Corey as long as he continues to hurt Prince William County and the state of Virginia. I am but one voice. Others are out there….shhhh…listen…you will hear them.

For the record, I don’t know Corey. This is not a personal issue. he is a self serving politician who has clearly stated political goals that are not in the best interest of PWC or VA.

Just out of curiosity, what’s your connection to him, TP? I know when you showed up here. I would have pegged you for having connections with the local ‘Elvis impersonator.’ However, I think the apple falls a little closer to Mr. STewart.
